Last updated: April 18, 2026. These terms apply to blackvineyardevents.com (the “Site”), the Black Vineyard Events mobile application for iOS (the “iOS App”), and the Black Vineyard Events mobile application for Android (the “Android App,” together with the iOS App, the “Apps”).

1. Who we are

Black Vineyard Events (“we,” “us,” “our”) operates the Site and Apps as a planning and discovery platform focused on Martha’s Vineyard events, culture, and curated Black-owned business context. Contact: blackvineyardevents@gmail.com.

2. Acceptance

By accessing the Site, downloading or using an App, or submitting information to us (for example through email or promotion inquiries), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Site or Apps.

3. Informational listings and third parties

Event listings, business spotlights, and editorial profiles are provided for general planning and cultural context. Official dates, ticketing, admission, safety rules, and venue policies are controlled by the applicable organizers, venues, and businesses. Always confirm details with official sources before making travel or purchase decisions.

The Site and Apps may link to third-party websites, maps, calendars, ticket sellers, or social platforms. Those services have their own terms and privacy practices. We are not responsible for third-party content, availability, or actions.

4. Accounts and eligibility

App features that require sign-in (for example phone authentication) are subject to technical and anti-abuse measures we or our providers apply. You agree to provide accurate information and to keep any credentials or device access secure. You must be old enough under applicable law to enter into these terms for your jurisdiction.

5. Acceptable use

You will not misuse the Site or Apps, including by attempting to gain unauthorized access, scraping or harvesting data in bulk without permission, interfering with security or performance, harassing others, or violating law. We may suspend or terminate access where reasonably necessary to protect users, partners, or infrastructure.

6. Intellectual property

The Black Vineyard Events name, branding, Site design, original text, and curated compilation (excluding third-party marks and materials) are owned by us or our licensors. You receive a limited, revocable license to use the Site and Apps for personal, non-commercial planning purposes. You may not copy, modify, distribute, or create derivative works from our materials without prior written consent, except as allowed by law.

7. Listings, promotions, and submissions

Business and event visibility on the platform may be curated or permission-based. Submitting a listing or promotion request does not guarantee placement. You represent that information you submit is accurate and that you have authority to share it.

8. Advertising

The Apps may display advertisements served by Google and other partners. Ad delivery is governed by the relevant ad network policies and your device settings where available.

9. Disclaimers

THE SITE AND APPS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CONTENT IS COMPLETE, CURRENT, OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLACK VINEYARD EVENTS AND ITS FOUNDERS, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR APPS. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR APPS IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY) OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

11. Indemnity

You will defend and indemnify Black Vineyard Events and its personnel against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or Apps, your violation of these terms, or your violation of others’ rights.

12. Changes

We may update these terms from time to time. We will post the updated version on this page and revise the “Last updated” date. Continued use after changes constitutes acceptance of the revised terms.

13. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, USA, excluding conflict-of-law rules. Courts in Massachusetts have exclusive jurisdiction, subject to mandatory consumer protections in your home jurisdiction where applicable.
